Florida shortened its negligence deadline in 2023. For a claim that accrued after March 24, 2023, you have two years to file suit, half the four years the law allowed before.

A wrongful death claim runs on its own two-year clock, measured from the death. Both periods are outer limits. The practical window is shorter, because a carrier's driving logs only have to be kept for six months.

Florida reduces your damages by your share of the fault. Since the 2023 changes, a person found greater than 50 percent at fault for his or her own harm may not recover any damages in a negligence case.

A carrier's insurer can use that rule to argue about a lane change or a sudden stop on the Dolphin Expressway or I-95. The answer is evidence gathered early: the truck's electronic logs, its maintenance history and what nearby cameras recorded.

A Miami-Dade case is filed in the circuit court of the Eleventh Judicial Circuit. When the carrier is from another state and more than $75,000 is in dispute, it can often be moved to the federal Southern District of Florida, which holds court in Miami.
